Child

A child is a person below eighteen (18) years of age, or a person eighteen (18) years of age or over who is unable to fully take care of herself or himself or protect herself or himself from abuse, neglect, cruelty, exploitation, or mental disability or condition. This definition is substantially used in the following laws:

• Simulated Birth Rectification Act (R.A. No. 11222, Sec. 3(b))
• Special Protection of Children in Situations of Armed Conflict Act (R.A. No. 11188, Sec. 5(g))
• Children’s Emergency Relief and Protection Act (R.A. No. 10821, Sec. 3(a))

Under the Child Safety in Motor Vehicles Act, Republic Act No. 11229, approved February 22, 2019, a child is a person below 12 years old. (Sec. 3(b), R.A. No. 11229)
