Compensation
Under the Social Security Act of 2018, compensation refers to actual remuneration for cost-of-living allowance, as well as the cash value of any remuneration paid in any medium other than cash except that part of the remuneration received during the month in excess of the maximum salary credit as provided in the law. Under the Overseas Workers Welfare Administration Act, compensation refers to the basic pay or salary received by an officer or employee of the Overseas Workers Welfare Administration (OWWA), pursuant to the official appointment, excluding per diems, bonuses, overtime pay, honoraria, allowances and any other emoluments received that are not integrated into the basic pay under existing laws. Under the National Labor Relations Commission (NLRC) or any labor arbiter, the National Conciliation and Mediation Board (NCMB), the Philippine Overseas Employment Administration (POEA), theDepartment of Labor and Employment (DOLE) or its regional offices, any voluntary arbitrators or other quasi-judicial bodies handling labor disputes to the attorney’s fees and other litigation expenses and settlement award given through out-of-the-court agreement between the parties.
