Employer
Under the Safe Spaces Act, an employer refers to a person who exercises control over an employee. For purposes of R.A. No. 11313, the status or conditions of the latter's employment or engagement shall be disregarded. (Sec. 3(c), R.A. No. 11313)
Under the Social Security Act of 2018, an employer is any person, natural or juridical, domestic or foreign, who carries on in the Philippines any trade, business, industry, undertaking, or activity of any kind and uses the services of another person who is under his orders as regards the employment, except the government and any of its political subdivisions, branches or instrumentalities, including corporations owned or controlled by the Government. A self-employed person shall be both employee and employer at the same time. (Sec. 3(c), R.A. No. 11199)
Under R.A. No. 11058, entitled “An Act Strengthening Compliance with Occupational Safety and Health Standards and Providing Penalties for Violations Thereof”, an employer refers to any person, natural or juridical, including the principal employer, contractor or subcontractor, if any, who directly or indirectly benefits from the services of the employee. Under the Anti-Age Discrimination in Employment Act, employer refers to any person, natural or juridical, employing the services of an employee or worker and shall include the government and all its branches, subdivisions and instrumentalities, all government-owned and -controlled corporations, and government financial institutions, as well as nonprofit private institutions or organizations. Under the JobStart Philippines Act, employer refers to an establishment or an enterprise which may be a company, sole proprietorship, partnership, corporation, or any other legal entity registered under relevant laws that may provide a venue for training and placement of JobStart trainees.
