With all due respect to the prosecutors who penned the inquest resolution, Mr. Mas’ extrajudicial admission before the NBI that he was indeed the author of the subject post could not have cured the invalidity of the arrest.
If an extrajudicial admission generally is inadmissible, how could it cure an invalid arrest?
Nonetheless, this is an illustration of what I have always advocated: protect your right, no matter how guilty you are, by just shutting up and asking for an impartial and competent lawyer to assist you even during custodial investigation. Anybody who has a problem with that right expressly guaranteed by our Constitution and our laws has no business being in law enforcement.
